President Trump Signs Executive Orders Modifying China’s Fentanyl Tariffs And Reciprocal Tariffs
On Tuesday, November 4, President Trump issued two executive orders implementing commitments between the United States and China. The two executive orders formally implement the agreements outlined in a White House Fact Sheet, which summarizes outcomes from last week’s meeting between President Trump and Chinese President Xi Jinping.
International Emergency Economic Powers Act (IEEPA) Fentanyl Tariffs:
- The Executive Order implements the lowering of IEEPA fentanyl tariffs on Chinese goods from 20% to 10% on Chinese goods entered for consumption on or after 12:01 am EST on Monday, November 10, 2025.
- This executive order comes after China’s verbal commitment to take significant measures to end the flow of fentanyl to the United States, including stopping the shipment of certain designated chemicals to North America and controlling exports of other chemicals to all destinations in the world.
IEEPA Reciprocal Tariffs:
- The Executive Order implements the extension of the 10% IEEPA reciprocal tariff originally set to expire on November 10, 2025, to November 10, 2026.
Customs guidance has not yet been released for either Executive Order.
Procedural action is still needed to implement the remaining U.S. commitments listed in the White House Fact Sheet, including:
- Extension of certain Section 301 China product exclusions to November 10, 2026.
- One-year suspension of the implementation of the interim final rule titled Expansion of End-User Controls to Cover Affiliates of Certain Listed Entities.
- One-year suspension of USTR’s actions taken pursuant to the Section 301 investigation into China’s targeting of the maritime, logistics, and shipbuilding sectors for dominance.
New China “Stack”:
Starting on or after 12:01 am EST on Monday, November 10, 2025, Chinese-origin goods entered for consumption into the U.S. will be charged:
- Normal MFN Duty +
- 10% IEEPA fentanyl tariff +
- 10% IEEPA reciprocal tariffs +
- Applicable Sections 201, 232, 301, and/or antidumping/countervailing tariffs.
