USTR Initiates Section 301 Investigations Into Several Countries

On Wednesday, March 11, 2026, United States Trade Representative Jamieson Greer announced the initiation of multiple Section 301 investigations following the Supreme Court’s invalidation of tariffs imposed using the International Emergency Economic Powers Act (IEEPA). The investigations will assess whether the specified nations’ acts, policies, and practices are unreasonable or discriminatory and whether they burden or restrict U.S. commerce, with respect to structural excess capacity and manufacturing production. 

Countries under investigation are as follows: 

  • China, the European Union, Singapore, Switzerland, Norway, Indonesia, Malaysia, Cambodia, Thailand, Korea, Vietnam, Taiwan, Bangladesh, Mexico, Japan, and India. 

USTR has identified different sectors of concern for each country and has flagged steel, aluminum, automotive, batteries, energy goods, machine tools/machinery, plastics, semiconductors, chips, solar, and transportation equipment among additional specific areas of concern. For Indonesia, USTR flagged metals, agricultural products, fuels, textiles, and construction goods.

USTR will open a docket for public comments from March 17 through April 15 and hold a hearing on May 5. U.S. Trade Representative Greer and Treasury Secretary Scott Bessent have both suggested that the investigations will take about five months to complete and will rebuild “old [IEEPA] tariffs.”

The investigations present an opportunity for importers to seek tariff relief for domestic manufacturing operations and for goods not commercially produced in the Western Hemisphere. By law, USTR must collect input from public stakeholders during the course of the investigations.
