Minnesota Pollution Control Agency Reaffirms September 15 PFAS Reporting Deadline
On Monday, June 15, the Minnesota Pollution Control Agency (MPCA) reaffirmed that manufacturers subject to Minnesota’s PFAS reporting requirements must submit initial reports by Tuesday, September 15, 2026.
As defined by Amara’s Law, manufacturers who sell products into Minnesota must report which products contain intentionally added PFAS, including a description of the product, the purpose/function that PFAS serves in the product, and the amount and identity of each type of PFAS.
For manufacturers that need additional time to collect and report the required information, MPCA is offering a 90-day extension. Extension requests must be postmarked by August 16, 2026. If the extension request is approved, reports from manufacturers receiving extensions will be due by December 14, 2026.
As a result of advocacy by the RV Industry Association and coalition partners, MPCA has recognized the challenges facing manufacturers and suppliers when collecting and reporting this information. An amendment signed by Governor Walz that makes a minor modification to Minnesota’s PFAS reporting requirements by excluding products made before July 1, 2023. Now, manufacturers must report products that are manufactured after July 1, 2023. Previously, products containing intentionally added PFAS had to be reported regardless of manufacture date. This amendment is found in 2026 Minn. Laws, ch. 127, art. 14, §4.
MPCA has extended the reporting deadline twice to September 15, 2026, and relaxed the due diligence standard for data submission for this first reporting period. For this initial reporting period, MPCA will accept all data collected to date, which will be considered in compliance. Annual updates are due each February, applying the more stringent due diligence standard that requires manufacturers to trace supply chain disclosures until all necessary information is obtained. A simple claim of supplier refusal is generally not legally acceptable. For more information about reporting, MPCA has updated guidance.
