A new law took effect in New York on April 1 that requires all solely battery-operated smoke detecting alarm devices that are distributed, sold, offered for sale or imported, to employ a non-removable, non-replaceable battery that powers the device for a minimum of ten years.
The provisions of this new law do not apply to battery-powered smoke detecting alarm devices which use a replaceable, removable battery if they have been ordered by, or are in the inventory of, owners, managing agents, contractors, wholesalers or retailers on or before April 1.
This new law primarily covers smoke alarms that are sold as aftermarket devices or as replacement devices for current alarms. Smoke alarms that are offered as original equipment by RV manufacturers would not be subject to these provisions.
All product packaging containing a solely battery-operated smoke detecting alarm device sold in New York after April 1 must include the following information:
- (a) the manufacturer's name or registered trademark and the model number of the smoke detecting alarm device; and
- (b) that such alarm device is designed to have a minimum battery life of ten years.
